G\u00e9n\u00e9rales de Vente (dites \u00ab CGV \u00bb) s&#8217;appliquent, sans restriction ni r\u00e9serve, \u00e0 l&#8217;ensemble des ventes conclues par le Vendeur aupr\u00e8s d&#8217;acheteurs non professionnels (\u00ab les Clients \u00bb ou \u00ab le Client \u00bb), d\u00e9sirant acqu\u00e9rir les produits propos\u00e9s \u00e0 la vente (\u00ab les Produits \u00bb) par le Vendeur sur le site <a href=\"https:\/\/www.mathisleroux.com\" target=\"_blank\" rel=\"noopener\">https:\/\/www.mathisleroux.com<\/a>.<\/p>\n<p>Les Produits propos\u00e9s \u00e0 la vente sur le site sont les suivants : \u0153uvres originales en bois r\u00e9alis\u00e9es \u00e0 la main, et tirages en \u00e9dition limit\u00e9e (reproductions d&#8217;\u0153uvres). Les tirages en \u00e9dition limit\u00e9e sont propos\u00e9s d&#8217;abord en pr\u00e9commande, lors d&#8217;une ou plusieurs vagues successives, puis en vente libre sur le site tant que l&#8217;\u00e9dition n&#8217;est pas \u00e9puis\u00e9e (article 16).<\/p>\n<p>Les caract\u00e9ristiques principales des Produits, et notamment les sp\u00e9cifications, illustrations et indications de dimensions, sont pr\u00e9sent\u00e9es sur le site <a href=\"https:\/\/www.mathisleroux.com\" target=\"_blank\" rel=\"noopener\">https:\/\/www.mathisleroux.com<\/a>, ce dont le Client est tenu de prendre connaissance avant de commander.<\/p>\n<p>Le choix et l&#8217;achat d&#8217;un Produit sont de la seule responsabilit\u00e9 du Client.<\/p>\n<p>Les offres de Produits s&#8217;entendent dans la limite des stocks disponibles, tels que pr\u00e9cis\u00e9s lors de la passation de la commande.<\/p>\n<p>Ces CGV sont accessibles \u00e0 tout moment sur le site <a href=\"https:\/\/www.mathisleroux.com\" target=\"_blank\" rel=\"noopener\">https:\/\/www.mathisleroux.com<\/a> et pr\u00e9valent sur tout autre document.<\/p>\n<p>Le Client d\u00e9clare avoir pris connaissance des pr\u00e9sentes CGV et les avoir accept\u00e9es en cochant la case pr\u00e9vue \u00e0 cet effet lors de la validation du formulaire de commande en ligne sur le site <a href=\"https:\/\/www.mathisleroux.com\" target=\"_blank\" rel=\"noopener\">https:\/\/www.mathisleroux.com<\/a>, avant toute facturation ou paiement. En cas de commande vers un pays autre que la France m\u00e9tropolitaine, le Client est l&#8217;importateur du ou des Produits concern\u00e9s. Pour tous les Produits exp\u00e9di\u00e9s hors Union europ\u00e9enne et DOM-TOM, le prix sera calcul\u00e9 hors taxes automatiquement sur la facture. Des droits de douane ou autres taxes locales, droits d&#8217;importation ou taxes d&#8217;\u00c9tat sont susceptibles d&#8217;\u00eatre exigibles. Ils seront \u00e0 la charge du Client et rel\u00e8vent de sa seule responsabilit\u00e9.<\/p>\n<\/section>\n<section id=\"cgv-fr-2\"><h2><span class=\"cgv-eyebrow\">Article 2<\/span>Prix<\/h2>\n<p>Les Produits sont fournis aux prix en vigueur sur le site web <a href=\"https:\/\/www.mathisleroux.com\" target=\"_blank\" rel=\"noopener\">https:\/\/www.mathisleroux.com<\/a> \u00e0 la date d&#8217;enregistrement de la commande par le Vendeur. Les prix sont exprim\u00e9s en euros. Le montant total d\u00fb par le Client est celui affich\u00e9 sur le site web au moment de la validation de la commande.<\/p>\n<p>Les prix tiennent compte des \u00e9ventuelles remises propos\u00e9es par le Vendeur sur le site web. Ces prix sont fixes et non n\u00e9gociables pendant leur p\u00e9riode de validit\u00e9. Le Vendeur se r\u00e9serve toutefois le droit de modifier ses prix \u00e0 tout moment, \u00e9tant entendu que le prix applicable est celui affich\u00e9 lors de l&#8217;enregistrement de la commande.<\/p>\n<p>Les prix n&#8217;incluent pas les frais de traitement, d&#8217;exp\u00e9dition, de transport et de livraison, le cas \u00e9ch\u00e9ant. Ces frais sont calcul\u00e9s en fonction de l&#8217;adresse de livraison fournie par le Client et sont indiqu\u00e9s avant la validation d\u00e9finitive de la commande.<\/p>\n<p>Le paiement demand\u00e9 au Client correspond au montant total de l&#8217;achat, incluant le prix du Produit et les frais de livraison applicables. Une facture est \u00e9mise par le Vendeur et remise au Client conform\u00e9ment \u00e0 la r\u00e9glementation en vigueur.<\/p>\n<\/section>\n<section id=\"cgv-fr-3\"><h2><span class=\"cgv-eyebrow\">Article 3<\/span>Commandes<\/h2>\n<p>Le Client peut acheter directement sur le site web toute \u0153uvre originale indiqu\u00e9e comme disponible \u00e0 la vente imm\u00e9diate, ainsi que tout tirage en \u00e9dition limit\u00e9e ouvert \u00e0 la pr\u00e9commande ou \u00e0 la vente libre, dans les conditions de l&#8217;article 16.<\/p>\n<p>Chaque \u0153uvre originale est une pi\u00e8ce unique, notamment par sa couleur. Lorsque le Vendeur r\u00e9alise une nouvelle version d&#8217;un mod\u00e8le existant dans une autre couleur, cette version constitue une \u0153uvre distincte. Elle est mise en ligne sur le site et peut \u00eatre achet\u00e9e directement tant qu&#8217;elle est indiqu\u00e9e comme disponible.<\/p>\n<p>Une \u0153uvre originale vendue n&#8217;est pas reproduite \u00e0 l&#8217;identique (m\u00eame couleur). Le Client qui souhaite un mod\u00e8le existant dans une autre couleur doit contacter le Vendeur via le formulaire de contact disponible sur le site Internet, par e-mail ou via les comptes de r\u00e9seaux sociaux officiels du Vendeur.<\/p>\n<p>Suite \u00e0 la demande, le Vendeur fournit un devis pr\u00e9cisant les caract\u00e9ristiques de l&#8217;\u0153uvre (dont la couleur), le prix, les frais de livraison et le d\u00e9lai estim\u00e9 de production et de livraison.<\/p>\n<p>La commande sur devis ne devient d\u00e9finitive qu&#8217;apr\u00e8s :<\/p>\n<ul>\n<li>acceptation du devis par le Client ;<\/li>\n<li>paiement int\u00e9gral du montant indiqu\u00e9 sur le devis.<\/li>\n<\/ul>\n<p>Les tirages en \u00e9dition limit\u00e9e (article 16) peuvent \u00eatre command\u00e9s sur le site web, d&#8217;abord pendant les vagues de pr\u00e9commande dont les dates sont indiqu\u00e9es sur la fiche produit, puis, si l&#8217;\u00e9dition n&#8217;est pas \u00e9puis\u00e9e, en vente libre, dans la limite des exemplaires disponibles. Une pr\u00e9commande n&#8217;est possible que pendant la p\u00e9riode d&#8217;ouverture de la vague concern\u00e9e.<\/p>\n<p>Le Vendeur se r\u00e9serve le droit de refuser toute demande, notamment lorsque la r\u00e9alisation est techniquement impossible, lorsque le Vendeur ne souhaite plus produire le mod\u00e8le ou en cas de litige avec le Client.<\/p>\n<p>Les offres de produits restent valables tant qu&#8217;elles sont affich\u00e9es sur le site web et sous r\u00e9serve de disponibilit\u00e9.<\/p>\n<\/section>\n<section id=\"cgv-fr-4\"><h2><span class=\"cgv-eyebrow\">Article 4<\/span>Conditions de paiement<\/h2>\n<p>Pour les \u0153uvres originales et les tirages disponibles \u00e0 l&#8217;achat sur le site web, qu&#8217;il s&#8217;agisse d&#8217;une pr\u00e9commande ou d&#8217;une vente libre, le paiement est d\u00fb en totalit\u00e9 au moment de la commande via le syst\u00e8me de paiement s\u00e9curis\u00e9 disponible sur le site web.<\/p>\n<p>Pour les \u0153uvres r\u00e9alis\u00e9es sur devis, le paiement est d\u00fb en totalit\u00e9 d\u00e8s l&#8217;acceptation du devis et avant le d\u00e9but de la production.<\/p>\n<p>La production ne d\u00e9butera pas avant que le paiement int\u00e9gral n&#8217;ait \u00e9t\u00e9 re\u00e7u par le Vendeur. Pour les tirages command\u00e9s en pr\u00e9commande, la production est lanc\u00e9e \u00e0 la cl\u00f4ture de la vague de pr\u00e9commande concern\u00e9e.<\/p>\n<p>Les paiements peuvent \u00eatre effectu\u00e9s par carte de cr\u00e9dit via la plateforme de paiement s\u00e9curis\u00e9e disponible sur le site web, par lien de paiement s\u00e9curis\u00e9 ou par virement bancaire.<\/p>\n<p>Le Vendeur conserve l&#8217;enti\u00e8re propri\u00e9t\u00e9 de l&#8217;\u0153uvre ou du tirage jusqu&#8217;au paiement int\u00e9gral du prix et des frais y aff\u00e9rents.<\/p>\n<\/section>\n<section id=\"cgv-fr-5\"><h2><span class=\"cgv-eyebrow\">Article 5<\/span>Livraisons<\/h2>\n<p>Les produits command\u00e9s par le Client seront livr\u00e9s en France m\u00e9tropolitaine ou \u00e0 l&#8217;\u00e9tranger sur demande. Le d\u00e9lai de livraison en France m\u00e9tropolitaine est estim\u00e9 \u00e0 10 jours ouvr\u00e9s \u00e0 compter de la confirmation de commande et de la r\u00e9ception du paiement. Pour les livraisons internationales, le d\u00e9lai estim\u00e9 est de 10 \u00e0 15 jours ouvr\u00e9s, selon la destination et les conditions d&#8217;exp\u00e9dition. La livraison est r\u00e9put\u00e9e effectu\u00e9e d\u00e8s le transfert de la possession physique du produit au Client. Sauf indication contraire ou en cas d&#8217;indisponibilit\u00e9 d&#8217;un ou plusieurs produits, les produits command\u00e9s seront livr\u00e9s en un seul envoi. Le Vendeur s&#8217;engage \u00e0 tout mettre en \u0153uvre pour livrer les produits command\u00e9s par le Client dans les d\u00e9lais susmentionn\u00e9s. Si les produits command\u00e9s n&#8217;ont pas \u00e9t\u00e9 livr\u00e9s dans les dix (10) jours suivant la date de livraison estim\u00e9e, pour toute raison autre qu&#8217;un cas de force majeure ou une action du Client, la vente pourra \u00eatre annul\u00e9e \u00e0 la demande \u00e9crite du Client, conform\u00e9ment aux articles L216-2, L216-3 et L241-4 du Code de la consommation. Les sommes vers\u00e9es par le Client seront alors rembours\u00e9es dans un d\u00e9lai de quatorze (14) jours \u00e0 compter de la date d&#8217;annulation, sans aucune compensation ni d\u00e9duction.<\/p>\n<p><strong>Tirages en \u00e9dition limit\u00e9e.<\/strong> Par d\u00e9rogation \u00e0 ce qui pr\u00e9c\u00e8de, les tirages en \u00e9dition limit\u00e9e sont fabriqu\u00e9s \u00e0 la demande : ils sont imprim\u00e9s par un prestataire, puis contr\u00f4l\u00e9s, sign\u00e9s et num\u00e9rot\u00e9s par le Vendeur avant leur exp\u00e9dition.<\/p>\n<p><strong>Pr\u00e9commande.<\/strong> Pour les tirages command\u00e9s pendant une vague de pr\u00e9commande, la date de livraison estim\u00e9e est indiqu\u00e9e sur la fiche produit de la vague concern\u00e9e (par exemple \u00ab livraison au plus tard le 30 novembre 2026 \u00bb). Les tirages d&#8217;une m\u00eame vague sont imprim\u00e9s apr\u00e8s la cl\u00f4ture de cette vague, puis contr\u00f4l\u00e9s, sign\u00e9s, num\u00e9rot\u00e9s et exp\u00e9di\u00e9s. La date de livraison estim\u00e9e indiqu\u00e9e sur la fiche produit au moment de la commande est celle qui s&#8217;applique \u00e0 la commande. Pour l&#8217;application de la facult\u00e9 d&#8217;annulation pr\u00e9vue ci-dessus, la date de livraison estim\u00e9e d&#8217;un tirage pr\u00e9command\u00e9 est cette date.<\/p>\n<p><strong>Vente libre.<\/strong> Pour les tirages command\u00e9s en vente libre, apr\u00e8s les vagues de pr\u00e9commande, le d\u00e9lai de livraison estim\u00e9 est de 15 \u00e0 20 jours ouvr\u00e9s \u00e0 compter de la confirmation de commande et de la r\u00e9ception du paiement. Pour l&#8217;application de la facult\u00e9 d&#8217;annulation pr\u00e9vue ci-dessus, la date de livraison estim\u00e9e correspond \u00e0 la fin de ce d\u00e9lai maximal.<\/p>\n<p>Si un tirage doit \u00eatre r\u00e9imprim\u00e9 \u00e0 la suite du contr\u00f4le de qualit\u00e9, le Vendeur en informe le Client dans les meilleurs d\u00e9lais.<\/p>\n<p>Les livraisons sont assur\u00e9es par un transporteur ind\u00e9pendant, \u00e0 l&#8217;adresse mentionn\u00e9e par le Client lors de la commande et \u00e0 laquelle le transporteur pourra facilement acc\u00e9der. Lorsque le Client s&#8217;est lui-m\u00eame charg\u00e9 de faire appel \u00e0 un transporteur qu&#8217;il choisit lui-m\u00eame, la livraison est r\u00e9put\u00e9e effectu\u00e9e d\u00e8s la remise des Produits command\u00e9s par le Vendeur au transporteur qui les a accept\u00e9s sans r\u00e9serves. Le Client reconna\u00eet donc que c&#8217;est au transporteur qu&#8217;il appartient d&#8217;effectuer la livraison et ne dispose d&#8217;aucun recours en garantie contre le Vendeur en cas de d\u00e9faut de livraison des marchandises transport\u00e9es. En cas de demande particuli\u00e8re du Client concernant les conditions d&#8217;emballage ou de transport des produits command\u00e9s, d\u00fbment accept\u00e9es par \u00e9crit par le Vendeur, les co\u00fbts y li\u00e9s feront l&#8217;objet d&#8217;une facturation sp\u00e9cifique compl\u00e9mentaire, sur devis pr\u00e9alablement accept\u00e9 par \u00e9crit par le Client. Le Client est tenu de v\u00e9rifier l&#8217;\u00e9tat des produits livr\u00e9s. Il dispose d&#8217;un d\u00e9lai de 14 (quatorze) jours \u00e0 compter de la livraison pour formuler des r\u00e9clamations par mail, accompagn\u00e9es de tous les justificatifs y aff\u00e9rents (photos notamment). Pass\u00e9 ce d\u00e9lai et \u00e0 d\u00e9faut d&#8217;avoir respect\u00e9 ces formalit\u00e9s, les Produits seront r\u00e9put\u00e9s conformes et exempts de tout vice apparent et aucune r\u00e9clamation ne pourra \u00eatre valablement accept\u00e9e par le Vendeur.<\/p>\n<p>Le Vendeur remboursera ou remplacera dans les plus brefs d\u00e9lais et \u00e0 ses frais, les Produits livr\u00e9s dont les d\u00e9fauts de conformit\u00e9 ou les vices apparents ou cach\u00e9s auront \u00e9t\u00e9 d\u00fbment prouv\u00e9s par le Client, dans les conditions pr\u00e9vues aux articles L217-4 et suivants du Code de la consommation et celles pr\u00e9vues aux pr\u00e9sentes CGV. Le transfert des risques de perte et de d\u00e9t\u00e9rioration se rapportant aux Produits ne sera r\u00e9alis\u00e9 qu&#8217;au moment o\u00f9 le Client prendra physiquement possession des Produits. Les Produits voyagent donc aux risques et p\u00e9rils du Vendeur sauf lorsque le Client aura lui-m\u00eame choisi le transporteur. \u00c0 ce titre, les risques sont transf\u00e9r\u00e9s au moment de la remise du bien au transporteur.<\/p>\n<p>Pour les livraisons hors Union europ\u00e9enne, des droits de douane, taxes d&#8217;importation, frais de d\u00e9douanement ou autres taxes locales peuvent \u00eatre per\u00e7us par les autorit\u00e9s du pays de destination. Ces frais sont enti\u00e8rement \u00e0 la charge du Client. Il est de la responsabilit\u00e9 du Client de se renseigner aupr\u00e8s des autorit\u00e9s comp\u00e9tentes de son pays avant de passer commande.<\/p>\n<\/section>\n<section id=\"cgv-fr-6\"><h2><span class=\"cgv-eyebrow\">Article 6<\/span>Transfert de propri\u00e9t\u00e9<\/h2>\n<p>Le transfert de propri\u00e9t\u00e9 des Produits du Vendeur au Client ne sera r\u00e9alis\u00e9 qu&#8217;apr\u00e8s complet paiement du prix par ce dernier, et ce quelle que soit la date de livraison desdits Produits.<\/p>\n<\/section>\n<section id=\"cgv-fr-7\"><h2><span class=\"cgv-eyebrow\">Article 7<\/span>Droit de r\u00e9tractation<\/h2>\n<p>Pour les \u0153uvres originales et les tirages en \u00e9dition limit\u00e9e (pr\u00e9commande ou vente libre) vendus aux consommateurs r\u00e9sidant dans l&#8217;Union europ\u00e9enne, le Client b\u00e9n\u00e9ficie du droit l\u00e9gal de r\u00e9tractation pr\u00e9vu par les articles L221-18 et suivants du Code de la consommation fran\u00e7ais.<\/p>\n<p>Le Client dispose d&#8217;un d\u00e9lai de quatorze (14) jours \u00e0 compter de la r\u00e9ception de l&#8217;\u0153uvre ou du tirage pour exercer ce droit sans avoir \u00e0 justifier aucune raison. Il peut l&#8217;exercer d\u00e8s la commande, y compris avant la livraison, notamment pendant la p\u00e9riode de pr\u00e9commande. Il en informe le Vendeur par \u00e9crit (e-mail ou courrier) avant l&#8217;expiration de ce d\u00e9lai.<\/p>\n<p>L&#8217;\u0153uvre ou le tirage doit \u00eatre retourn\u00e9 dans son \u00e9tat d&#8217;origine, complet (avec son certificat d&#8217;authenticit\u00e9 le cas \u00e9ch\u00e9ant) et correctement prot\u00e9g\u00e9. Les frais de retour restent \u00e0 la charge du Client. Le Vendeur rembourse le Client dans un d\u00e9lai de quatorze (14) jours \u00e0 compter de la communication de sa d\u00e9cision de se r\u00e9tracter, et peut diff\u00e9rer ce remboursement jusqu&#8217;\u00e0 la r\u00e9ception du bien retourn\u00e9. Lorsque la r\u00e9tractation intervient avant la livraison, le remboursement est effectu\u00e9 dans le m\u00eame d\u00e9lai, sans attendre de retour. Toute d\u00e9pr\u00e9ciation de l&#8217;\u0153uvre ou du tirage r\u00e9sultant de manipulations autres que celles n\u00e9cessaires pour en \u00e9tablir la nature, les caract\u00e9ristiques et le bon fonctionnement engage la responsabilit\u00e9 du Client.<\/p>\n<p>Les tirages en \u00e9dition limit\u00e9e, bien que fabriqu\u00e9s apr\u00e8s la commande, sont des produits standardis\u00e9s et non personnalis\u00e9s : ils sont donc soumis au droit de r\u00e9tractation. En cas de r\u00e9tractation, le num\u00e9ro de l&#8217;exemplaire concern\u00e9 pourra \u00eatre r\u00e9attribu\u00e9 par le Vendeur.<\/p>\n<p>Pour les \u0153uvres r\u00e9alis\u00e9es sur devis \u00e0 la demande du Client (notamment un mod\u00e8le existant r\u00e9alis\u00e9 dans une couleur choisie par le Client), le droit de r\u00e9tractation ne s&#8217;applique pas, conform\u00e9ment \u00e0 l&#8217;article L221-28 du Code de la consommation, ces \u0153uvres \u00e9tant confectionn\u00e9es selon les sp\u00e9cifications du Client.<\/p>\n<p>Une fois le devis accept\u00e9 et le paiement re\u00e7u, la commande devient d\u00e9finitive et ne peut \u00eatre annul\u00e9e par le Client, sauf dans les cas pr\u00e9vus par la loi.<\/p>\n<\/section>\n<section id=\"cgv-fr-8\"><h2><span class=\"cgv-eyebrow\">Article 8<\/span>Responsabilit\u00e9 du vendeur \u2013 garanties<\/h2>\n<p>Les Produits fournis par le Vendeur b\u00e9n\u00e9ficient :<\/p>\n<ul>\n<li>de la garantie l\u00e9gale de conformit\u00e9, pour les Produits d\u00e9fectueux, ab\u00eem\u00e9s ou endommag\u00e9s ou ne correspondant pas \u00e0 la commande ;<\/li>\n<li>de la garantie l\u00e9gale contre les vices cach\u00e9s provenant d&#8217;un d\u00e9faut de mati\u00e8re, de conception ou de fabrication affectant les produits livr\u00e9s et les rendant impropres \u00e0 l&#8217;utilisation.<\/li>\n<\/ul>\n<p>Afin de faire valoir ses droits, le Client devra informer le Vendeur, par \u00e9crit (mail ou courrier), de la non-conformit\u00e9 des Produits ou de l&#8217;existence des vices cach\u00e9s \u00e0 compter de leur d\u00e9couverte.<\/p>\n<p>Le Vendeur remboursera, remplacera ou fera r\u00e9parer les Produits ou pi\u00e8ces sous garantie jug\u00e9s non conformes ou d\u00e9fectueux.<\/p>\n<p>Les frais d&#8217;envoi seront rembours\u00e9s sur la base du tarif factur\u00e9 et les frais de retour seront rembours\u00e9s sur pr\u00e9sentation des justificatifs.<\/p>\n<p>Les remboursements, remplacements ou r\u00e9parations des Produits jug\u00e9s non conformes ou d\u00e9fectueux seront effectu\u00e9s dans les meilleurs d\u00e9lais et au plus tard dans les quatorze (14) jours suivant la constatation par le Vendeur du d\u00e9faut de conformit\u00e9 ou du vice cach\u00e9. Ce remboursement pourra \u00eatre fait par virement.<\/p>\n<p>La responsabilit\u00e9 du Vendeur ne saurait \u00eatre engag\u00e9e dans les cas suivants :<\/p>\n<ul>\n<li>non-respect de la l\u00e9gislation du pays dans lequel les produits sont livr\u00e9s, qu&#8217;il appartient au Client de v\u00e9rifier ;<\/li>\n<li>mauvaise utilisation, utilisation \u00e0 des fins professionnelles, n\u00e9gligence ou d\u00e9faut d&#8217;entretien de la part du Client, usure normale du Produit, accident ou force majeure ;<\/li>\n<li>les photographies et graphismes pr\u00e9sent\u00e9s sur le site ne sont pas contractuels et ne sauraient engager la responsabilit\u00e9 du Vendeur.<\/li>\n<\/ul>\n<p>La garantie du Vendeur est, en tout \u00e9tat de cause, limit\u00e9e au remplacement ou au remboursement des Produits non conformes ou affect\u00e9s d&#8217;un vice.<\/p>\n<\/section>\n<section id=\"cgv-fr-9\"><h2><span class=\"cgv-eyebrow\">Article 9<\/span>Propri\u00e9t\u00e9 intellectuelle<\/h2>\n<p>L&#8217;ensemble des \u0153uvres d&#8217;art, tirages, cr\u00e9ations, sculptures, reliefs, photographies, illustrations, textes, vid\u00e9os, \u00e9l\u00e9ments graphiques et contenus figurant sur le site web restent la propri\u00e9t\u00e9 exclusive de Mathis Leroux et sont prot\u00e9g\u00e9s par les lois fran\u00e7aises et internationales sur la propri\u00e9t\u00e9 intellectuelle.<\/p>\n<p>L&#8217;acquisition d&#8217;une \u0153uvre originale ou d&#8217;un tirage ne transf\u00e8re que la propri\u00e9t\u00e9 physique de l&#8217;objet achet\u00e9. Aucun droit de propri\u00e9t\u00e9 intellectuelle n&#8217;est transf\u00e9r\u00e9 au Client.<\/p>\n<p>Sans autorisation \u00e9crite pr\u00e9alable de l&#8217;artiste, il est express\u00e9ment interdit au Client de :<\/p>\n<ul>\n<li>reproduire l&#8217;\u0153uvre ou le tirage sous quelque forme que ce soit ;<\/li>\n<li>cr\u00e9er des copies ou des \u0153uvres d\u00e9riv\u00e9es ;<\/li>\n<li>effectuer tout processus de num\u00e9risation tridimensionnelle, de mod\u00e9lisation num\u00e9rique, de photogramm\u00e9trie ou de reproduction ;<\/li>\n<li>utiliser l&#8217;\u0153uvre ou le tirage \u00e0 des fins commerciales, publicitaires, promotionnelles, \u00e9ditoriales, audiovisuelles ou de marchandisage ;<\/li>\n<li>exploiter les images de l&#8217;\u0153uvre ou du tirage \u00e0 des fins commerciales ;<\/li>\n<li>fabriquer, commander ou autoriser la fabrication de copies inspir\u00e9es de l&#8217;\u0153uvre.<\/li>\n<\/ul>\n<p>Toute utilisation non autoris\u00e9e peut donner lieu \u00e0 des poursuites judiciaires et \u00e0 des demandes de dommages et int\u00e9r\u00eats.<\/p>\n<p>L&#8217;artiste conserve tous les droits \u00e9conomiques et moraux attach\u00e9s \u00e0 l&#8217;\u0153uvre, y compris les droits de reproduction, de repr\u00e9sentation, d&#8217;adaptation et d&#8217;int\u00e9grit\u00e9 de l&#8217;\u0153uvre.<\/p>\n<\/section>\n<section id=\"cgv-fr-10\"><h2><span class=\"cgv-eyebrow\">Article 10<\/span>Donn\u00e9es personnelles<\/h2>\n<p>Le Vendeur collecte et conserve les donn\u00e9es personnelles n\u00e9cessaires \u00e0 la gestion des commandes, des paiements et des livraisons. Ces informations peuvent \u00eatre communiqu\u00e9es au transporteur en charge de la livraison. Conform\u00e9ment au R\u00e8glement G\u00e9n\u00e9ral sur la Protection des Donn\u00e9es (RGPD) et \u00e0 la loi Informatique et Libert\u00e9s du 6 janvier 1978 modifi\u00e9e, le Client dispose d&#8217;un droit d&#8217;acc\u00e8s, de rectification, d&#8217;opposition, d&#8217;effacement et de portabilit\u00e9 de ses donn\u00e9es. Il peut exercer ce droit \u00e0 tout moment en adressant un courriel \u00e0 l&#8217;adresse indiqu\u00e9e par le Vendeur ou en envoyant une demande par courrier postal. Les donn\u00e9es personnelles sont conserv\u00e9es pendant une dur\u00e9e maximale de 3 ans \u00e0 compter du dernier contact avec le Client ou du dernier achat, puis supprim\u00e9es, sauf conservation n\u00e9cessaire pour des obligations l\u00e9gales ou comptables.<\/p>\n<\/section>\n<section id=\"cgv-fr-11\"><h2><span class=\"cgv-eyebrow\">Article 11<\/span>Force majeure<\/h2>\n<p>Le Vendeur ne saurait \u00eatre tenu responsable de tout manquement \u00e0 ses obligations contractuelles r\u00e9sultant d&#8217;un cas de force majeure tel que d\u00e9fini par l&#8217;article 1218 du Code civil et la jurisprudence fran\u00e7aise. Sont notamment consid\u00e9r\u00e9s comme cas de force majeure : catastrophes naturelles, incendies, inondations, gr\u00e8ves totales ou partielles, interruptions de transport, guerres, r\u00e9quisitions, \u00e9pid\u00e9mies\/pand\u00e9mies, d\u00e9cisions gouvernementales ou tout autre \u00e9v\u00e9nement ind\u00e9pendant de la volont\u00e9 du Vendeur. En cas de survenance d&#8217;un tel \u00e9v\u00e9nement, le Vendeur informera le Client dans les meilleurs d\u00e9lais ; la commande pourra \u00eatre suspendue ou annul\u00e9e sans indemnit\u00e9.<\/p>\n<\/section>\n<section id=\"cgv-fr-12\"><h2><span class=\"cgv-eyebrow\">Article 12<\/span>M\u00e9diation et r\u00e8glement des litiges<\/h2>\n<p>Avant toute action judiciaire, le Client est invit\u00e9 \u00e0 contacter le Vendeur afin de rechercher une solution amiable. \u00c0 d\u00e9faut d&#8217;accord amiable dans un d\u00e9lai raisonnable, le Client pourra recourir gratuitement au m\u00e9diateur de la consommation comp\u00e9tent. Le m\u00e9diateur peut \u00eatre, par exemple, le Centre de m\u00e9diation et de r\u00e8glement amiable, ou tout autre m\u00e9diateur agr\u00e9\u00e9. Les coordonn\u00e9es exactes du m\u00e9diateur retenu seront communiqu\u00e9es sur simple demande \u00e0 l&#8217;adresse du Vendeur. \u00c0 d\u00e9faut d&#8217;accord amiable, tout litige relatif \u00e0 l&#8217;interpr\u00e9tation, l&#8217;ex\u00e9cution ou la validit\u00e9 des pr\u00e9sentes CGV sera soumis \u00e0 la comp\u00e9tence exclusive des tribunaux fran\u00e7ais comp\u00e9tents.<\/p>\n<\/section>\n<section id=\"cgv-fr-13\"><h2><span class=\"cgv-eyebrow\">Article 13<\/span>Droit applicable<\/h2>\n<p>Les pr\u00e9sentes Conditions G\u00e9n\u00e9rales de Vente et les op\u00e9rations qui en d\u00e9coulent sont r\u00e9gies par le droit fran\u00e7ais. Elles sont r\u00e9dig\u00e9es en langue fran\u00e7aise. En cas de traduction, seule la version fran\u00e7aise fera foi.<\/p>\n<\/section>\n<section id=\"cgv-fr-14\"><h2><span class=\"cgv-eyebrow\">Article 14<\/span>Acceptation du client<\/h2>\n<p>Le fait pour un Client de commander sur le site <a href=\"https:\/\/www.mathisleroux.com\" target=\"_blank\" rel=\"noopener\">https:\/\/www.mathisleroux.com<\/a> emporte adh\u00e9sion et acceptation pleine et enti\u00e8re des pr\u00e9sentes Conditions G\u00e9n\u00e9rales de Vente. Le Client reconna\u00eet avoir pris connaissance et avoir accept\u00e9 les pr\u00e9sentes CGV avant la passation de sa commande.<\/p>\n<\/section>\n<section id=\"cgv-fr-15\"><h2><span class=\"cgv-eyebrow\">Article 15<\/span>\u0152uvres originales : pi\u00e8ces uniques<\/h2>\n<p>Chaque \u0153uvre originale propos\u00e9e par Mathis Leroux est une cr\u00e9ation artistique unique, notamment par sa couleur.<\/p>\n<p>Une \u0153uvre originale vendue n&#8217;est pas reproduite \u00e0 l&#8217;identique. Un mod\u00e8le existant peut toutefois \u00eatre r\u00e9alis\u00e9 dans une autre couleur ; cette version constitue alors une \u0153uvre distincte, propos\u00e9e sur le site ou sur devis (article 3).<\/p>\n<p>Le Vendeur se r\u00e9serve le droit, \u00e0 tout moment et sans justification, de cesser de produire un mod\u00e8le.<\/p>\n<p>Aucun Client n&#8217;acquiert le droit d&#8217;exiger la r\u00e9alisation d&#8217;une \u0153uvre qui n&#8217;a pas encore \u00e9t\u00e9 cr\u00e9\u00e9e.<\/p>\n<\/section>\n<section id=\"cgv-fr-16\"><h2><span class=\"cgv-eyebrow\">Article 16<\/span>Tirages en \u00e9dition limit\u00e9e : pr\u00e9commande et vente libre<\/h2>\n<p>Le Vendeur propose \u00e9galement des tirages en \u00e9dition limit\u00e9e. Ces tirages sont des reproductions d&#8217;\u0153uvres et ne constituent pas des \u0153uvres d&#8217;art originales.<\/p>\n<p>Chaque tirage est propos\u00e9 selon trois gammes :<\/p>\n<ul>\n<li><strong>\u00c9dition Fine Art<\/strong> : 100 exemplaires maximum ;<\/li>\n<li><strong>\u00c9dition Premium<\/strong> : 30 exemplaires maximum ;<\/li>\n<li><strong>\u00c9dition Prestige<\/strong> : 8 exemplaires maximum.<\/li>\n<\/ul>\n<p>Les caract\u00e9ristiques propres \u00e0 chaque gamme (support, format, finition) sont pr\u00e9cis\u00e9es sur la fiche du produit sur le site web.<\/p>\n<p>Les nombres indiqu\u00e9s sont des maximums, valables pour l&#8217;ensemble de l&#8217;\u00e9dition, toutes phases de vente confondues (pr\u00e9commande et vente libre). Les tirages sont fabriqu\u00e9s \u00e0 la demande : le Vendeur n&#8217;imprime pas l&#8217;\u00e9dition \u00e0 l&#8217;avance, et le nombre d&#8217;exemplaires effectivement produits peut \u00eatre inf\u00e9rieur au maximum annonc\u00e9.<\/p>\n<p><strong>Phase 1 : pr\u00e9commande par vagues.<\/strong> La commercialisation d&#8217;un tirage d\u00e9bute par une ou plusieurs vagues de pr\u00e9commande. Les dates d&#8217;ouverture et de cl\u00f4ture de la vague en cours, ainsi que la date de livraison estim\u00e9e, sont indiqu\u00e9es sur la fiche produit. Le Vendeur n&#8217;est pas tenu d&#8217;annoncer \u00e0 l&#8217;avance le nombre ni les dates des vagues suivantes. Une nouvelle vague n&#8217;est ouverte que si l&#8217;\u00e9dition n&#8217;est pas \u00e9puis\u00e9e, et le Vendeur reste libre d&#8217;en d\u00e9cider. Le paiement est d\u00fb en totalit\u00e9 au moment de la pr\u00e9commande (article 4). \u00c0 la cl\u00f4ture d&#8217;une vague, les tirages command\u00e9s sont produits, contr\u00f4l\u00e9s, sign\u00e9s, num\u00e9rot\u00e9s puis exp\u00e9di\u00e9s (article 5).<\/p>\n<p><strong>Phase 2 : vente libre.<\/strong> Apr\u00e8s les vagues de pr\u00e9commande, si l&#8217;\u00e9dition n&#8217;est pas \u00e9puis\u00e9e, les exemplaires restants sont propos\u00e9s en vente libre sur le site, dans la limite du nombre maximum d&#8217;exemplaires de chaque gamme. Les tirages sont alors fabriqu\u00e9s \u00e0 la demande, apr\u00e8s chaque commande, selon les d\u00e9lais pr\u00e9vus \u00e0 l&#8217;article 5.<\/p>\n<p>Chaque exemplaire porte la signature de l&#8217;artiste imprim\u00e9e au recto, dans le cadre de l&#8217;image. Chaque exemplaire est en outre num\u00e9rot\u00e9 (\u00ab n\/100 \u00bb, \u00ab n\/30 \u00bb ou \u00ab n\/8 \u00bb selon la gamme) et sign\u00e9 \u00e0 la main par l&#8217;artiste au dos, apr\u00e8s contr\u00f4le. Les num\u00e9ros sont attribu\u00e9s dans l&#8217;ordre des paiements re\u00e7us, toutes vagues et phases confondues. Le num\u00e9ro d&#8217;un exemplaire dont l&#8217;achat est annul\u00e9 ou retourn\u00e9 (article 7) peut \u00eatre r\u00e9attribu\u00e9.<\/p>\n<p>Lorsque le nombre maximum d&#8217;exemplaires d&#8217;une gamme est atteint, cette gamme est \u00e9puis\u00e9e et n&#8217;est plus propos\u00e9e, y compris lors des vagues ou phases suivantes. Le Vendeur peut \u00e9galement clore une \u00e9dition avant que le nombre maximum d&#8217;exemplaires n&#8217;ait \u00e9t\u00e9 atteint, notamment \u00e0 l&#8217;issue des vagues de pr\u00e9commande ou de la vente libre. Prices are expressed in euros. These prices are fixed and non-negotiable during their validity period. The Seller nevertheless reserves the right to change its prices at any time, it being understood that the applicable price is the one displayed when the order is registered.<\/p>\n<p>Prices do not include handling, shipping, transport and delivery costs, where applicable. These costs are calculated based on the delivery address provided by the Customer and are shown before the order is finally confirmed.<\/p>\n<p>The payment requested from the Customer corresponds to the total purchase amount, including the price of the Product and the applicable delivery costs. An invoice is issued by the Seller and given to the Customer in accordance with the regulations in force.<\/p>\n<\/section>\n<section id=\"cgv-en-3\"><h2><span class=\"cgv-eyebrow\">Article 3<\/span>Orders<\/h2>\n<p>The Customer may purchase directly on the website any original artwork indicated as available for immediate sale, as well as any limited edition print open for pre-order or open sale, under the conditions of Article 16.<\/p>\n<p>Each original artwork is a unique piece, notably because of its color. When the Seller creates a new version of an existing model in a different color, that version is a separate artwork. It is published on the website and may be purchased directly for as long as it is shown as available.<\/p>\n<p>An original artwork that has been sold is not reproduced identically (same color). A Customer who wishes to obtain an existing model in a different color must contact the Seller through the contact form on the website, by email, or through the Seller&#8217;s official social media accounts.<\/p>\n<p>Following the request, the Seller provides a quote specifying the characteristics of the artwork (including its color), the price, the delivery costs and the estimated production and delivery time.<\/p>\n<p>An order placed on the basis of a quote becomes final only after:<\/p>\n<ul>\n<li>the Customer has accepted the quote; and<\/li>\n<li>full payment of the amount stated in the quote.<\/li>\n<\/ul>\n<p>Limited edition prints (Article 16) can be ordered on the website, first during the pre-order waves whose dates are shown on the product page, then, if the edition is not sold out, in open sale, subject to the copies available. A pre-order can only be placed while the relevant wave is open.<\/p>\n<p>The Seller reserves the right to refuse any request, in particular where production is technically impossible, where the Seller no longer wishes to produce the model, or in the event of a dispute with the Customer.<\/p>\n<p>Product offers remain valid for as long as they are displayed on the website and subject to availability.<\/p>\n<\/section>\n<section id=\"cgv-en-4\"><h2><span class=\"cgv-eyebrow\">Article 4<\/span>Payment terms<\/h2>\n<p>For original artworks and prints available for purchase on the website, whether as a pre-order or in open sale, payment is due in full when the order is placed, through the secure payment system available on the website.<\/p>\n<p>For artworks made on the basis of a quote, payment is due in full upon acceptance of the quote and before production begins.<\/p>\n<p>Production will not begin until the Seller has received full payment. For prints ordered as pre-orders, production starts when the relevant pre-order wave closes.<\/p>\n<p>Payments may be made by credit card through the secure payment platform available on the website, by secure payment link, or by bank transfer.<\/p>\n<p>The Seller remains the full owner of the artwork or print until the price and related costs have been paid in full.<\/p>\n<\/section>\n<section id=\"cgv-en-5\"><h2><span class=\"cgv-eyebrow\">Article 5<\/span>Delivery<\/h2>\n<p>The Products ordered by the Customer will be delivered in metropolitan France or abroad on request. The estimated delivery time in metropolitan France is 10 working days from order confirmation and receipt of payment. For international deliveries, the estimated time is 10 to 15 working days, depending on the destination and shipping conditions. Delivery is deemed to have taken place once physical possession of the Product has been transferred to the Customer. Unless otherwise indicated or in the event that one or more Products are unavailable, the Products ordered will be delivered in a single shipment. The Seller undertakes to make every effort to deliver the Products ordered by the Customer within the above-mentioned times. If the Products ordered have not been delivered within ten (10) days after the estimated delivery date, for any reason other than force majeure or an action by the Customer, the sale may be cancelled at the Customer&#8217;s written request, in accordance with Articles L216-2, L216-3 and L241-4 of the French Consumer Code. The sums paid by the Customer will then be refunded within fourteen (14) days of the date of cancellation, without any compensation or deduction.<\/p>\n<p><strong>Limited edition prints.<\/strong> Notwithstanding the above, limited edition prints are made to order: they are printed by a service provider, then checked, signed and numbered by the Seller before shipment.<\/p>\n<p><strong>Pre-orders.<\/strong> For prints ordered during a pre-order wave, the estimated delivery date is shown on the product page for that wave (for example &#8220;delivery by 30 November 2026&#8221;). The prints of a given wave are printed after that wave closes, then checked, signed, numbered and shipped. The estimated delivery date shown on the product page when the order is placed is the one that applies to that order. For the purposes of the cancellation right provided for above, the estimated delivery date of a pre-ordered print is that date.<\/p>\n<p><strong>Open sale.<\/strong> For prints ordered in open sale, after the pre-order waves, the estimated delivery time is 15 to 20 working days from order confirmation and receipt of payment. For the purposes of the cancellation right provided for above, the estimated delivery date is the end of that maximum time.<\/p>\n<p>If a print has to be reprinted following the quality check, the Seller will inform the Customer as soon as possible.<\/p>\n<p>Deliveries are carried out by an independent carrier, to the address given by the Customer when ordering and to which the carrier can easily gain access. Where the Customer has themselves arranged a carrier of their own choice, delivery is deemed to have taken place once the Seller has handed the ordered Products to the carrier, who has accepted them without reservation. The Customer therefore acknowledges that it is the carrier&#8217;s responsibility to make the delivery and has no warranty claim against the Seller in the event of non-delivery of the goods carried. Where the Customer makes a special request regarding the packaging or transport conditions of the Products ordered, duly accepted in writing by the Seller, the related costs will be invoiced separately, on the basis of a quote previously accepted in writing by the Customer. The Customer must check the condition of the Products delivered. The Customer has fourteen (14) days from delivery to submit complaints by email, together with all supporting evidence (in particular photos). After this period, and failing compliance with these formalities, the Products will be deemed compliant and free of any apparent defect, and no claim may validly be accepted by the Seller.<\/p>\n<p>The Seller will refund or replace, as soon as possible and at its own expense, Products delivered whose lack of conformity or apparent or hidden defects have been duly proven by the Customer, under the conditions provided for in Articles L217-4 et seq. of the French Consumer Code and in these Terms. The transfer of the risk of loss and damage relating to the Products takes place only when the Customer takes physical possession of the Products. The Products therefore travel at the Seller&#8217;s risk, except where the Customer has chosen the carrier themselves. In that case, the risks are transferred when the goods are handed over to the carrier.<\/p>\n<p>For deliveries outside the European Union, customs duties, import taxes, customs clearance fees or other local taxes may be charged by the authorities of the destination country. These costs are entirely borne by the Customer. It is the Customer&#8217;s responsibility to inquire with the competent authorities in their country before placing an order.<\/p>\n<\/section>\n<section id=\"cgv-en-6\"><h2><span class=\"cgv-eyebrow\">Article 6<\/span>Transfer of ownership<\/h2>\n<p>Ownership of the Products is transferred from the Seller to the Customer only after the Customer has paid the price in full, regardless of the date of delivery of the Products.<\/p>\n<\/section>\n<section id=\"cgv-en-7\"><h2><span class=\"cgv-eyebrow\">Article 7<\/span>Right of withdrawal<\/h2>\n<p>For original artworks and limited edition prints (pre-order or open sale) sold to consumers residing in the European Union, the Customer has the statutory right of withdrawal provided for in Articles L221-18 et seq. of the French Consumer Code.<\/p>\n<p>The Customer has fourteen (14) days from receipt of the artwork or print to exercise this right without having to give any reason. The Customer may exercise it as soon as the order is placed, including before delivery, in particular during the pre-order period. The Customer must notify the Seller in writing (email or letter) before the end of this period.<\/p>\n<p>The artwork or print must be returned in its original condition, complete (with its certificate of authenticity, where applicable) and properly protected. Return costs are borne by the Customer. The Seller will refund the Customer within fourteen (14) days of being informed of the decision to withdraw, and may defer the refund until the returned item has been received. Where the withdrawal takes place before delivery, the refund is made within the same period, without waiting for any return. The Customer is liable for any loss in value of the artwork or print resulting from handling other than what is necessary to establish its nature, characteristics and condition.<\/p>\n<p>Limited edition prints, although made after the order is placed, are standardized and not personalized products: they are therefore subject to the right of withdrawal. In the event of withdrawal, the number of the copy concerned may be reassigned by the Seller.<\/p>\n<p>For artworks made on the basis of a quote at the Customer&#8217;s request (in particular an existing model made in a color chosen by the Customer), the right of withdrawal does not apply, in accordance with Article L221-28 of the French Consumer Code, as these artworks are made to the Customer&#8217;s specifications.<\/p>\n<p>Once the quote has been accepted and payment received, the order becomes final and cannot be cancelled by the Customer, except in the cases provided for by law.<\/p>\n<\/section>\n<section id=\"cgv-en-8\"><h2><span class=\"cgv-eyebrow\">Article 8<\/span>Seller&#8217;s liability \u2013 warranties<\/h2>\n<p>The Products supplied by the Seller benefit from:<\/p>\n<ul>\n<li>the legal guarantee of conformity, for Products that are defective, damaged or do not match the order;<\/li>\n<li>the legal guarantee against hidden defects arising from a defect in material, design or manufacture affecting the Products delivered and making them unfit for use.<\/li>\n<\/ul>\n<p>To assert their rights, the Customer must inform the Seller in writing (email or letter) of the non-conformity of the Products or the existence of hidden defects from the time of their discovery.<\/p>\n<p>The Seller will refund, replace or repair the Products or parts under warranty found to be non-compliant or defective.<\/p>\n<p>Shipping costs will be refunded on the basis of the rate charged, and return costs will be refunded upon presentation of supporting documents.<\/p>\n<p>Refunds, replacements or repairs of Products found to be non-compliant or defective will be carried out as soon as possible and no later than fourteen (14) days after the Seller has established the lack of conformity or hidden defect. No intellectual property right is transferred to the Customer.<\/p>\n<p>Without the artist&#8217;s prior written authorization, the Customer is expressly prohibited from:<\/p>\n<ul>\n<li>reproducing the artwork or print in any form;<\/li>\n<li>creating copies or derivative works;<\/li>\n<li>carrying out any process of three-dimensional scanning, digital modeling, photogrammetry or reproduction;<\/li>\n<li>using the artwork or print for commercial, advertising, promotional, editorial, audiovisual or merchandising purposes;<\/li>\n<li>exploiting images of the artwork or print for commercial purposes;<\/li>\n<li>making, commissioning or authorizing the making of copies inspired by the artwork.<\/li>\n<\/ul>\n<p>Any unauthorized use may give rise to legal proceedings and claims for damages.<\/p>\n<p>The artist retains all economic and moral rights attached to the work, including the rights of reproduction, representation, adaptation and integrity of the work.<\/p>\n<\/section>\n<section id=\"cgv-en-10\"><h2><span class=\"cgv-eyebrow\">Article 10<\/span>Personal data<\/h2>\n<p>The Seller collects and retains the personal data necessary for the management of orders, payments and deliveries. This information may be shared with the carrier in charge of delivery. In accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act of 6 January 1978, as amended, the Customer has the right to access, rectify, object to, erase and port their data. The Customer may exercise this right at any time by sending an email to the address provided by the Seller or by sending a request by post. Personal data is kept for a maximum of 3 years from the last contact with the Customer or the last purchase, then deleted, except where retention is necessary for legal or accounting obligations.<\/p>\n<\/section>\n<section id=\"cgv-en-11\"><h2><span class=\"cgv-eyebrow\">Article 11<\/span>Force majeure<\/h2>\n<p>The Seller cannot be held liable for any failure to perform its contractual obligations resulting from a case of force majeure as defined by Article 1218 of the French Civil Code and French case law. The following in particular are considered cases of force majeure: natural disasters, fires, floods, total or partial strikes, transport disruptions, wars, requisitions, epidemics\/pandemics, government decisions or any other event beyond the Seller&#8217;s control. Should such an event occur, the Seller will inform the Customer as soon as possible; the order may be suspended or cancelled without compensation.<\/p>\n<\/section>\n<section id=\"cgv-en-12\"><h2><span class=\"cgv-eyebrow\">Article 12<\/span>Mediation and dispute resolution<\/h2>\n<p>Before any legal action, the Customer is invited to contact the Seller in order to seek an amicable solution. Failing an amicable agreement within a reasonable time, the Customer may use, free of charge, the competent consumer mediator. The mediator may be, for example, the Centre de m\u00e9diation et de r\u00e8glement amiable, or any other approved mediator. The exact contact details of the selected mediator will be provided on simple request to the Seller&#8217;s address. Failing an amicable agreement, any dispute relating to the interpretation, performance or validity of these Terms will be subject to the exclusive jurisdiction of the competent French courts.<\/p>\n<\/section>\n<section id=\"cgv-en-13\"><h2><span class=\"cgv-eyebrow\">Article 13<\/span>Governing law<\/h2>\n<p>These General Terms and Conditions of Sale and the transactions arising from them are governed by French law. They are drafted in French. In the event of translation, only the French version is authoritative.<\/p>\n<\/section>\n<section id=\"cgv-en-14\"><h2><span class=\"cgv-eyebrow\">Article 14<\/span>Customer&#8217;s acceptance<\/h2>\n<p>By placing an order on the website <a href=\"https:\/\/www.mathisleroux.com\" target=\"_blank\" rel=\"noopener\">https:\/\/www.mathisleroux.com<\/a>, the Customer fully and unreservedly accepts these General Terms and Conditions of Sale. The Customer acknowledges having read and accepted these Terms before placing their order.<\/p>\n<\/section>\n<section id=\"cgv-en-15\"><h2><span class=\"cgv-eyebrow\">Article 15<\/span>Original artworks: unique pieces<\/h2>\n<p>Each original artwork offered by Mathis Leroux is a unique artistic creation, notably because of its color.<\/p>\n<p>An original artwork that has been sold is not reproduced identically. An existing model may however be made in a different color; that version is then a separate artwork, offered on the website or on quote (Article 3).<\/p>\n<p>The Seller reserves the right, at any time and without justification, to stop producing a model.<\/p>\n<p>No Customer acquires the right to demand the creation of an artwork that has not yet been made.<\/p>\n<\/section>\n<section id=\"cgv-en-16\"><h2><span class=\"cgv-eyebrow\">Article 16<\/span>Limited edition prints: pre-order and open sale<\/h2>\n<p>The Seller also offers limited edition prints. These prints are reproductions of artworks and are not original works of art.<\/p>\n<p>Each print is offered in three ranges:<\/p>\n<ul>\n<li><strong>Fine Art Edition<\/strong>: maximum of 100 copies;<\/li>\n<li><strong>Premium Edition<\/strong>: maximum of 30 copies;<\/li>\n<li><strong>Prestige Edition<\/strong>: maximum of 8 copies.<\/li>\n<\/ul>\n<p>The characteristics specific to each range (medium, size, finish) are specified on the product page on the website.<\/p>\n<p>The numbers stated are maximums, applying to the whole edition, all sales phases combined (pre-order and open sale). Prints are made to order: the Seller does not print the edition in advance, and the number of copies actually produced may be lower than the stated maximum.<\/p>\n<p><strong>Phase 1: pre-order waves.<\/strong> The sale of a print begins with one or more pre-order waves. The opening and closing dates of the current wave, as well as the estimated delivery date, are shown on the product page. The Seller is not required to announce in advance the number or the dates of later waves. A new wave is opened only if the edition is not sold out, and the Seller remains free to decide on it. Payment is due in full when the pre-order is placed (Article 4). When a wave closes, the ordered prints are produced, checked, signed, numbered and then shipped (Article 5).<\/p>\n<p><strong>Phase 2: open sale.<\/strong> After the pre-order waves, if the edition is not sold out, the remaining copies are offered in open sale on the website, up to the maximum number of copies of each range. Prints are then made to order, after each order, within the times set out in Article 5.<\/p>\n<p>Each copy bears the artist&#8217;s signature printed on the front, within the image. Each copy is also numbered (&#8220;n\/100&#8221;, &#8220;n\/30&#8221; or &#8220;n\/8&#8221; depending on the range) and hand-signed by the artist on the back, after inspection. Numbers are assigned in the order in which payments are received, across all waves and phases. The number of a copy whose purchase is cancelled or returned (Article 7) may be reassigned.<\/p>\n<p>When the maximum number of copies of a range is reached, that range is sold out and is no longer offered, including in later waves or phases. The Seller may also close an edition before the maximum number of copies has been reached, in particular at the end of the pre-order waves or of the open sale. Once an edition is closed, the corresponding print is no longer produced or reissued in that range.<\/p>\n<p>Prints, whether ordered as pre-orders or in open sale, are subject to the right of withdrawal provided for in Article 7.<\/p>\n<p>Articles 9 (intellectual property), 18 (artistic nature) and 19 (certificate of authenticity) apply to prints.<\/p>\n<\/section>\n<section id=\"cgv-en-17\"><h2><span class=\"cgv-eyebrow\">Article 17<\/span>Cancellation of orders made on quote<\/h2>\n<p>Any order placed after acceptance of a quote and payment by the Customer is firm and final.<\/p>\n<p>As artworks made on the basis of a quote are produced specifically for the Customer, no cancellation, withdrawal, modification, refund or exchange may be requested once production has begun, unless mandatory legal provisions provide otherwise.<\/p>\n<p>Should the Customer refuse delivery of an artwork made on the basis of a quote or fail to collect it, no refund will be due and the Seller will retain all sums paid as compensation for the work carried out and the materials used.<\/p>\n<\/section>\n<section id=\"cgv-en-18\"><h2><span class=\"cgv-eyebrow\">Article 18<\/span>Artistic nature of the works<\/h2>\n<p>The Customer acknowledges that the Products sold are artistic creations or reproductions of artistic creations.<\/p>\n<p>The photographs displayed on the website are intended solely to give a general representation of the artwork or print.<\/p>\n<p>Slight variations in color, texture, grain, finish, dimensions, materials, lighting effects, relief details or visual appearance may exist between the photographs and the Product delivered.<\/p>\n<p>These variations are inherent to the artistic and handmade nature of the works and do not constitute a defect, a non-conformity or a valid reason for cancellation, refund or replacement.<\/p>\n<\/section>\n<section id=\"cgv-en-19\"><h2><span class=\"cgv-eyebrow\">Article 19<\/span>Certificate of authenticity<\/h2>\n<p>Each original artwork and each print may be accompanied by a certificate of authenticity issued by the artist, stating, where applicable, the number of the copy.<\/p>\n<p>Loss, destruction or deterioration of the certificate after delivery will not give rise to the issue of a duplicate, unless expressly agreed by the Seller.<\/p>\n<p>The Seller reserves the right to charge
